General Terms and Conditions of Sale.
1. Purpose
These General Terms and Conditions of Sale are intended to define the conditions under which Rieu Frais offers the sale and delivery of bottles of wine to its customers, following a request made via the website, by telephone, by email, or by any other available means of contact.
Sales are made exclusively by quote. No order for bottles of wine is finalized directly on the website.
After the customer has accepted the quote, Rieu Frais sends the customer a secure payment link enabling them to pay for the order remotely.

3. Products concerned
The products offered for sale are bottles of wine, subject to availability.
The essential characteristics of the products, including the name, vintage where indicated, capacity, unit price, available quantities, and any delivery fees, are specified in the quote sent to the customer.
Photographs or visuals appearing on the website are provided for information purposes only and have no contractual value.
4. Sale of alcohol and protection of minors
The sale of alcohol is strictly prohibited to minors under the age of 18.
By submitting a quote request and confirming an order for alcoholic beverages, the customer declares that they are aged 18 or over and have the legal capacity to enter into a contract.
Rieu Frais reserves the right to request any supporting document required to verify the age of the customer or of the person receiving the delivery. In case of doubt regarding the legal age of the customer or recipient, Rieu Frais reserves the right to refuse the sale or delivery.
Alcohol abuse is dangerous for your health. Please consume in moderation.
5. Quote request
The customer may submit a quote request via the form available on the website or by any other means of contact indicated by Rieu Frais.
To allow the quote to be prepared, the customer is invited to provide the necessary information, including:
the references or types of wine desired;
the quantities requested;
the customer’s contact details;
the delivery address;
any useful details concerning the order or delivery.
The quote request does not constitute a firm order. It only allows Rieu Frais to review the customer’s request and send them a commercial proposal.
6. Preparation and validity of the quote
Rieu Frais sends the customer a personalized quote specifying in particular:
the selected products;
the quantities;
the unit prices;
the total amount of the order;
any delivery fees;
the payment terms;
the estimated delivery terms or timeframes;
the validity period of the quote.
Unless otherwise stated on the quote, it is valid for a period of one month from its issue date.
After this period, Rieu Frais reserves the right to modify the quote, particularly in the event of price changes, product unavailability, or changes to delivery conditions.
7. Acceptance of the quote and formation of the order
The order is considered confirmed when the customer expressly accepts the quote sent by Rieu Frais.
Acceptance of the quote may be made by email reply, signature of the quote, written approval, or any other means agreed between Rieu Frais and the customer.
Acceptance of the quote implies the customer’s full and unconditional acceptance of these General Terms and Conditions of Sale.
Rieu Frais reserves the right to refuse any order for legitimate reasons, particularly in the event of product unavailability, an abnormal request, suspected fraud, non-payment, or inability to deliver to the address provided.
8. Prices
Prices are indicated in euros, including all taxes, unless otherwise stated.
The applicable prices are those appearing on the quote accepted by the customer.
Delivery fees, where applicable, are indicated in the quote before the customer confirms the order.
Rieu Frais reserves the right to change its prices at any time. However, products are invoiced on the basis of the quote accepted by the customer, subject to the quote’s validity and product availability.
9. Payment
After acceptance of the quote, Rieu Frais sends the customer a secure payment link via the Up2Pay solution.
Payment for the order is made by bank card, directly on the secure interface of the payment provider.
Rieu Frais does not collect, process, or store any bank card data. Banking information is entered directly on the secure platform of the payment provider.
The order is prepared after effective receipt of payment.
In the event of refused, incomplete, or non-received payment, Rieu Frais reserves the right to suspend or cancel the order.
10. Product availability
Product offers are valid subject to stock availability.
In the event of total or partial unavailability of a product after acceptance of the quote, Rieu Frais informs the customer as soon as possible.
Rieu Frais may offer the customer:
a replacement product;
a modification of the order;
a refund for the unavailable product;
or the total cancellation of the order if it cannot be fulfilled.
The customer remains free to accept or refuse any replacement proposal.
11. Delivery
Delivery terms are specified in the quote sent to the customer.
Delivery is made to the address provided by the customer when making the request or accepting the quote.
The customer is responsible for the accuracy of the information provided. In the event of an error in the delivery address or the customer’s absence at the time of delivery, any additional costs may be charged to the customer.
The delivery times communicated are provided for information purposes only, unless an express commitment is stated in the quote.
Rieu Frais may not be held liable for delivery delays caused by force majeure, an error by the customer, the recipient’s absence, or any circumstance beyond its control.
12. Receipt of the order
The customer is invited to check the condition of the products upon receipt.
In the event of a damaged parcel, broken bottle, missing product, or apparent non-conformity, the customer must inform Rieu Frais as soon as possible, ideally with photographs allowing the issue to be verified.

After verification, Rieu Frais may offer, depending on the case, replacement of the product, a credit note, or a refund.
13. Right of withdrawal
In accordance with the provisions of the French Consumer Code applicable to distance contracts, the consumer customer is generally entitled to a period of fourteen days from receipt of the products to exercise their right of withdrawal, without having to provide any reason.
To exercise their right of withdrawal, the customer must notify Rieu Frais of their decision by means of a clear and unambiguous statement, for example by email or postal mail, using the following contact details:

The customer may use the model withdrawal form included in the appendix to these General Terms and Conditions of Sale, although this is not mandatory.
Products must be returned in their original condition, unopened, unconsumed, undamaged, and in packaging allowing them to be transported in good conditions.
Return costs are borne by the customer, unless otherwise indicated by Rieu Frais or in the event of a non-compliant product.
Rieu Frais will refund the sums due under the conditions provided for by the applicable regulations, after receipt of the returned products or after receipt of proof that the products have been dispatched.
The refund may be deferred until the products have been recovered or until the customer has provided proof of dispatch of the products.
14. Exceptions to the right of withdrawal
The right of withdrawal does not apply in certain cases provided for by law, particularly for products made according to the customer’s specifications or clearly personalized, or for products likely to deteriorate or expire rapidly.
Where the order includes personalized products or products subject to an exception to the right of withdrawal, this information will be specified to the customer before the order is confirmed.
15. Legal guarantees
The customer benefits from the applicable legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects, under the conditions provided for by the French Consumer Code and the French Civil Code.
In the event of a non-compliant or defective product, the customer is invited to contact Rieu Frais as soon as possible using the contact details provided in these General Terms and Conditions of Sale.
16. Liability
Rieu Frais undertakes to take the greatest care in the preparation and delivery of orders.
Rieu Frais may not be held liable in the event of improper use of the products, excessive alcohol consumption, unsuitable storage after delivery, an error in the information provided by the customer, or the occurrence of a force majeure event.
The customer is responsible for preserving the products after delivery.
17. Personal data
As part of quote requests, order management, payment, and delivery, Rieu Frais may collect and process personal data concerning the customer, including their surname, first name, email address, telephone number, delivery address, and information necessary for order tracking.
This data is used solely to respond to customer requests, prepare quotes, manage orders, ensure delivery, carry out customer follow-up, and comply with applicable legal obligations.
Banking data is neither collected nor stored by Rieu Frais. It is processed directly by the secure payment provider Up2Pay.
The customer has rights over their personal data, including the right of access, rectification, objection, erasure, and restriction of processing, under the conditions provided for by the applicable regulations.

18. Intellectual property
The content appearing on the Rieu Frais website, including texts, images, photographs, logos, graphic elements, and editorial content, is protected by the applicable rules on intellectual property.

20. Consumer mediation
In accordance with the provisions of the French Consumer Code, the consumer customer may use a consumer mediator free of charge with a view to the amicable resolution of a dispute with Rieu Frais, after first submitting a written complaint to Rieu Frais.
Rieu Frais is a member of the consumer mediation scheme offered by Société Médiation Professionnelle, approved as a consumer mediator by the CECMC.

21. Applicable law
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties will endeavor to seek an amicable solution before taking any legal action.
Failing amicable resolution, the dispute may be brought before the competent courts under ordinary law conditions.
22. Modification of the General Terms and Conditions of Sale
Rieu Frais reserves the right to modify these General Terms and Conditions of Sale at any time.
The applicable General Terms and Conditions of Sale are those in force at the time the quote is accepted by the customer.
